Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Bronx Colors website and your purchase of products through our online store. By placing an order or using this site, you agree to be bound by these Terms.

This site is governed by South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002("ECT Act"). Nothing in these Terms limits any right you have under that legislation.

2. Who Can Use This Site

You must be at least 18 years old, or using the site under the supervision of a parent or legal guardian, and legally able to enter into a binding contract to place an order with us. By ordering, you confirm this is the case.


 

3. Products, Pricing & Availability

• We take care to display products and pricing accurately, but errors may occur. If we discover a pricing or listing error after you've placed an order, we'll contact you before processing payment or delivery, and you may cancel at no charge.
• All prices are listed in South African Rand (ZAR) and include VAT where applicable, unless stated otherwise.
• Prices and product availability may change at any time without notice, but changes won't affect orders already confirmed.
• Product images are for illustration; actual colour may vary slightly due to screen settings.

 

4. Orders & Formation of Contract

• Placing an order is an offer to purchase, which we may accept or decline (for example, due to stock unavailability or a pricing error).
• A contract is only formed once we've confirmed your order and payment has been successfully processed.
• We'll send an order confirmation to the email address you provide; please check your details are correct, as we aren't responsible for delays or non-delivery caused by inaccurate information you've supplied.

 

5. Payment & Security

• Payment is required in full at checkout, via the payment methods listed on the site.
• We use a third-party payment gateway to process transactions securely; we don't store your full card details.
• We reserve the right to refuse or cancel an order where we reasonably suspect fraud or unauthorised use of a payment method.

 

6. Delivery

• We aim to deliver within the timeframes indicated at checkout. In line with section 46 of the ECT Act, orders will be fulfilled within 30 days of receipt unless otherwise agreed, and if we can't meet this, you'll be notified and may cancel for a full refund.
• Delivery costs, where applicable, are shown at checkout before you complete your order.
• Risk in the products passes to you on delivery to the address you provide; ownership passes once payment has been received in full.
• Please inspect your order on delivery and report any damage, shortage, or incorrect items promptly see our Returns Policy for details.

 

7. Returns, Refunds & Exchanges

Returns, exchanges and refunds are handled in accordance with our Returns Policy, available at [insert link], which forms part of these Terms. This includes your 7-day statutory cooling-off right under the ECT Act, your 6-month implied warranty rights under the CPA, and our extended 30-day voluntary return period.

All content on this site including text, graphics, logos, product images, and design is owned by or licensed to Bronx Colors and is protected by South African copyright and trademark law. You may not reproduce, distribute, or use this content for commercial purposes without our prior written consent.


 

9. Acceptable Use

• use it for any unlawful purpose or in a way that infringes anyone else's rights;
• attempt to gain unauthorised access to our systems or interfere with the site's operation; or
• submit false, misleading, or fraudulent information, including when placing an order.

We may suspend or terminate your access to the site if we reasonably believe you've breached these Terms.


 

10. Limitation of Liability

To the maximum extent permitted by law:

• We aren't liable for any indirect, incidental, or consequential loss arising from your use of this site or our products, except where such liability cannot be excluded under the CPA (for example, harm caused by unsafe or defective products under section 61).
• We aren't responsible for delays or failures caused by circumstances beyond our reasonable control (such as courier delays, load shedding, or system outages).

Nothing in this clause limits your statutory rights under the CPA or ECT Act.


 

11. Indemnity

You agree to indemnify Bronx Colors against any claim, loss, or damage arising from your misuse of the site, breach of these Terms, or violation of any law or third-party right, except to the extent caused by our own negligence or breach.
